Terms & Conditions

Introduction

These terms and conditions (“Terms”) govern the relationship between Head Up Studio (“Head Up Studio” or “we”) and the client (“Client” or “you”) for the provision of photo, video and equipment services (“Services”). By using our Services, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use our Services.

Services

Head Up Studio provides photo, video and equipment services to the Client. This includes, but is not limited to, photography, videography, equipment rental, and post-production services. The specific Services to be provided will be agreed upon by both Head Up Studio and the Client prior to the start of the project.

Payment

The Client will be invoiced for the Services provided by Head Up Studio. Payment is due upon receipt of invoice. If the Client does not pay within the terms agreed upon, Head Up Studio has the right to terminate the project and retain any payments made to date.

Cancellation Policy

If the Client wishes to cancel the project, they must do so in writing at least 14 days prior to the start date of the project. If the Client cancels within 14 days of the start date, they will be responsible for paying 50% of the total cost of the project. If the Client cancels on the day of the project, they will be responsible for paying 100% of the total cost of the project.

Intellectual Property

The photographs and videos produced by Head Up Studio during the course of the project will remain the property of Head Up Studio. The Client will be granted a non-exclusive, non-transferable license to use the photographs and videos for the purposes outlined in the project agreement.

Liability

Head Up Studio will not be liable for any damages resulting from the use of our Services, including but not limited to, any loss of profits or revenue, any loss of data, or any indirect or consequential damages.

Governing Law

These Terms will be governed by and construed in accordance with the laws of the country in which Head Up Studio is located.

Dispute Resolution

Any disputes arising out of or related to these Terms will be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

Changes to Terms

Head Up Studio reserves the right to change these Terms at any time without notice. The latest version of these Terms will be posted on our website. By continuing to use our Services, you agree to be bound by the latest version of these Terms.
